Since 2024 the federal notice service at oeffentlichevergabe.de has aggregated German procurement notices, taking feeds from the federal and state platforms including the federal eVergabe platform (evergabe-online.de), Vergabeplattform Berlin, Vergabe NRW, Vergabe Bayern and the municipal marketplaces run by the states. Procedures above the EU thresholds are also published in the EU Official Journal (TED). Polytender reads both routes and merges a national notice with its TED mirror into a single procurement.

Above the EU thresholds, German competition law applies (GWB part 4, VgV, SektVO, VOB/A-EU); the thresholds currently sit at 143,000 euro for supplies and services of central federal authorities, 221,000 euro for other contracting authorities and 5,538,000 euro for works. How public tendering works in Germany
Public contracts in Germany are advertised, awarded and challenged under fixed rules, and which rules apply depends on the contract value. Above the published thresholds a fully advertised, formal procedure is mandatory; below them lighter national procedures apply up to fixed value limits. Notices run through Datenservice Öffentliche Vergabe (oeffentlichevergabe.de) and the regional portals - Polytender reads them all.
Procedures above the thresholds
- Offenes Verfahren
- Advertised publicly, and every interested company may submit a bid straight away. The widest competition and the standard route.
- Nicht offenes Verfahren
- Advertised publicly, but in two stages: first a request to participate, then only the shortlisted companies are invited to bid.
- Verhandlungsverfahren mit Teilnahmewettbewerb
- Two stages as well, but the buyer may negotiate the submitted bids with the shortlisted companies before awarding.
- Wettbewerblicher Dialog
- For complex contracts: the buyer discusses possible solutions with the shortlisted companies and only then asks for final bids.
- Innovationspartnerschaft
- For something the market does not offer yet - the development and the subsequent purchase are awarded in one single procedure.
Procedures below the thresholds
- Öffentliche Ausschreibung
- The below-threshold counterpart of the open procedure: publicly advertised, open to every company.
- Beschränkte Ausschreibung
- Only a limited number of companies are asked to bid. Permitted in defined cases and up to defined value limits.
- Freihändige Vergabe / Verhandlungsvergabe
- No formal procedure: the buyer approaches suitable companies and may negotiate the terms. The choice has to be justified and documented.
- Direktauftrag
- Small contracts up to a fixed value limit can be awarded directly to one company, without a competition.
From notice to award in Germany

Find the notice
Contracting authorities have to advertise. Above the thresholds the notice is public by law; below them it appears on Datenservice Öffentliche Vergabe (oeffentlichevergabe.de) or a regional portal. Polytender reads those portals daily, so one search covers all of them.

Read the tender documents
The documents define the scope, the award criteria and the two dates that matter: the deadline for questions, which is usually well before the deadline for bids.

Prove your suitability
Buyers check economic standing, technical capability and the absence of exclusion grounds - normally through a self-declaration first, with the certificates requested only from the winner.

Submit the bid
Bids go in electronically through the platform, complete and on time. A bid that arrives after the deadline is excluded, however good it is.

Award and review
The contract goes to the most economically advantageous tender, which is not automatically the cheapest. Unsuccessful bidders are told before the contract is signed and can have the decision reviewed under Gesetz gegen Wettbewerbsbeschränkungen (GWB), Teil 4.
